CICA Payout Examples For Criminal Injury Claims

When making a claim through the CICA, you could be awarded compensation that takes into account the injuries you have suffered. If you are wondering, ‘how much compensation for criminal injuries can I claim?‘, we have provided some examples of CICA payouts for different types of injuries below.

These figures have been taken from the tariff of injuries set out in the Criminal Injuries Compensation Scheme 2012. Your injuries will be valued in line with this tariff when making a claim through the CICA.

You could also claim for multiple injuries through the CICA under the multiple injuries formula. This means that you will receive the following compensation:

  1. 100% for the highest-valued injury.
  2. 30% for the second most highly or equally valued injury.
  3. 15% for the third most highly or equally valued injury.

You may also be able to claim compensation from a different tariff that is not subjected to this formula if you have contracted an STI, lost a foetus or became pregnant as a result of a crime of violence.

Examples Of CICA Payouts For Special Expenses

Additionally, you could be awarded compensation for any special expenses you have incurred. Some examples of special expenses you could be compensated for include:

  • Home adaptations that you needed to cope with your injury, such as a stair lift or ramp.
  • Any equipment that was damaged in the incident that you relied on as a physical aid, e.g. your hearing aids or glasses.
  • Care costs that relate to your bodily functions or preparing food.
  • Any equipment you need to cope with your injuries, such as a specially adapted car.

All of these costs must have directly resulted from your injury and must be necessary and reasonable. Furthermore, they cannot be available for free anywhere else.

Examples Of CICA Payouts For Loss Of Earnings

You could also claim back a loss of earnings as part of your claim. However, you must be able to show that you were unable to work for 28 full weeks after the incident. If you can, you will then be compensated from the 29th week onwards for your loss of earnings.

Criteria To Claim CICA Payouts

Before we provide examples of CICA payouts, let us explain who could be eligible to claim compensation via the CICA.

To be able to make a criminal injury claim through the CICA, you must show that you meet the following eligibility requirements:

  1. You must have been injured in a crime of violence. Sexual assault, arson, an attack and threat of attack are some examples the CICA Scheme define as a crime of violence.
  2. The incident must have taken place in Great Britain (England, Wales or Scotland). Or, it must have taken place in another relevant place, such as a ship registered in one of these countries.
  3. You must have reported the crime to the police.
  4. Your claim must be made within the correct time limit. We will discuss this in more depth in another section.

CICA Claim Time Limits

There is generally a 2-year time limit when making a claim through the CICA. This time limit will run from the date you reported the incident to the police, which you are usually expected to do right away. However, exceptions could be made if you can prove exceptional circumstances prevented you from reporting it.

Exceptions could also be made to the 2-year limit in which you have to begin your claim if you can prove that exceptional circumstances stopped you from starting your claim within this time period.

What Evidence Do I Need For A Criminal Injury Claim?

When you are making a criminal injury claim through the CICA for compensation, you will need to provide the following evidence:

  • Medical evidence that confirms your injuries, such as a copy of your medical records.
  • A police reference number to confirm that the incident was reported to the police.
  • Proof that you meet the residency requirements.
