Have You Been Injured Abroad On Holiday?
More than a quarter of all visitors to the sun-kissed Spanish island come from the UK, making up one of the largest groups of tourists. Whilst most of these people will have a great holiday, some will experience an accident on holiday in Formentera.
No one expects to be victim to an accident or injury whilst on holiday, however for some this is the way their holiday will end. Being involved in an accident or injury abroad can be more stressful than being injured at home. Unfamiliar languages and surroundings can make things harder to deal with than if you were in the UK.
If you have been hurt in a package holiday accident or other form of accident and need to make a holiday compensation claim, you can get in touch with our team to start your claim.

Before looking at what you should do, we need to establish that you do have a valid holiday compensation claim for an accident or illness. Think about these quick questions.
- Were you sick before you went abroad, or did you have any injuries?
- Did you eat at your hotel and swim in the hotel swimming pool?
- Did your illness start on holiday or just after you got home, or did your injury become apparent at this time?
If you answer no to the first question, and yes to the others, you may have grounds to make a compensation claim. If you think you do need to make a personal injury holiday claim make sure that you collect together any evidence such as medical reports and receipts of expenses you have had to meet. Also make sure that your accident, injury, or illness has been correctly reported to the authorities or parties it needs to be recorded with such as police, your hotel, travel company, and insurance provider.
In addition to the emergency services numbers which we have included below, we have also included details on how to contact the local British Consulate serving the islands, and the main embassy located in Madrid. In emergencies, such as fatal accidents, you may be able to get additional assistance and advice from the bodies.
As formenter is a smaller island, it shares some services and numbers with its larger neighbour, Ibiza.
- Emergency services – 112
- Local emergency Service – 061
- National police service – 091
- Municipal or local police – 092
- Guardia Civil (Ibiza island) – 971 301 100
- Sea-rescue service – 900 202 202
If you are injured whilst on holiday here, you can access healthcare and medical services under the same terms as Spanish nationals/ residents. In order to do so you will need to have a current and valid Global Health Insurance Card. You can apply for a new card at this NHS site, or even download and use the GHIC smartphone app from your smartphone app store.
We do also recommend that people take out travel insurance which includes things such as medical and emergency healthcare cover, as well as the cost of staying longer in your destination or having to return to the UK in an emergency as these are not covered by the GHIC.
If you are in Formentera or elsewhere in the EU and do not have your card with you, you can dial +44 191 218 1999 to speak to the NHS Department of Health Overseas Healthcare who can issue a temporary card in an emergency.
If you need to make a personal injury holiday claim or other form of compensation claim for an accident abroad, you need to be aware that the mount of time which you have to make your claim, or limitation period, may be different from that in the UK. If you do not make your claim within this time period, you may have no legal grounds in which to do so.
If you were injured in a package holiday accident abroad you may be able to bring your claim wholelly in the UK and under UK law, meaning you will still have the standard three years in which to make a personal injury claim. If you need to make a claim for a car crash in Formentera or an accident on your flight, the amount of time you have to make a claim is different and it may also vary somewhat.
For an accurate and up-to-date assessment of the time limit you have to make your claim, please contact our team today on the number below.
|Circumstances in which you were harmed||Limitation period|
|Illness or injury in Spain where a package holiday company in the UK is responsible.||3 years may very|
|Non package holiday accidents and injuries||1 year (time limits can vary)|

There are numerous different ways in which you can slip or fall over due to someone else’s fault. Of these, the most serious can be balcony accidents. You may have grounds to claim compensation if the accident was caused by your hotel failing to maintain or secure the balcony, window, or doors, and accidents happening as a result.
Wet floors as well as highly polished flooring, such as in your hotels reception area, can be a leading cause of slips or falls which could have been prevented. If the hotel has had reasonable to to either clear the spillage up, or place a warning sign, you may have grounds to claim compensation.
If other areas of your hotel, such as a stairway have either not been properly maintained, or are poorly lit, you may find that you trip or fall over. In such cases, it it likely that your hotel was responsible for your accident happening and you being injured.
Activities such as water sports can often be a great way to try out new experiences whilst on holiday. However, they can also be dangerous if you are not correctly instructed in how to participate safely, or not correctly observed whilst participating. - White water rafting on the open water.
- Diving activities such as snorkelling, scuba diving, or free diving.

In this guide, you can find out more about how to make a package holiday accident claim for a holiday accident in Spain.
What evidence do I need to support my claim for an accident on holiday in Formentera?
If you are looking to support your claim with a strong body of evidence, you may want to collect the following.
Evidence that the accident occurred- to prove that an accident occurred, you may need a police report, or photographs of the scene or your injuries. It could also be useful to draw a diagram of the positioning of vehicles if you’re injured in a car accident. It would also be a good idea to write down details of what has happened as soon as possible after the accident. This could help you to refresh your memory as time progress is. In addition to this you could collect witness details. That way, your lawyer could approach those people who have witnessed your accident and ask them for a statement.
Evidence of your injuries- in order to prove that you have suffered injuries in an accident, you would need to provide more than just a GP or hospital report. You would also need to attend an appointment with an independent medical specialist. They could take a look at your injuries and ask you some questions about what has happened and how your injury has affected you. Based on the information they collect, they could provide a medical report to evidence your injuries.
Evidence of costs- if you have incurred costs or loss of earnings, for example, you would need to provide documentary evidence of this.
