Before looking at what you should do, we need to establish that you do have a valid holiday compensation claim for an accident or illness. Think about these quick questions.

If you are injured whilst on holiday here, you can access healthcare and medical services under the same terms as Spanish nationals/ residents. In order to do so you will need to have a current and valid European Health Insurance Card. You can apply for a new card at this NHS site, or even download and use the EHIC smartphone app from your smartphone app store.
We do also recommend that people take out travel insurance which includes things such as medical and emergency healthcare cover, as well as the cost of staying longer in your destination or having to return to the UK in an emergency as these are not covered by the EHIC.
If you are in Formentera or elsewhere in the EU and do not have your card with you, you can dial +44 191 218 1999 to speak to the NHS Department of Health Overseas Healthcare who can issue a temporary card in an emergency.
If you need to make a personal injury holiday claim or other form of compensation claim for an accident abroad, you need to be aware that the mount of time which you have to make your claim, or limitation period, may be different from that in the UK. If you do not make your claim within this time period, you may have no legal grounds in which to do so.
If you were injured in a package holiday accident abroad you may be able to bring your claim wholelly in the UK and under UK law, meaning you will still have the standard three years in which to make a personal injury claim.
