What To Do If You Have A Holiday Accident In Spain

Before looking at what you should do, we need to establish that you do have a valid holiday compensation claim for an accident or illness. Think about these quick questions.

  1. Were you sick before you went abroad, or did you have any injuries?
  2. Did you eat at your hotel and swim in the hotel swimming pool?
  3. Did your illness start on holiday or just after you got home, or did your injury become apparent at this time?

If you answer no to the first question, and yes to the others, you may have grounds to make a compensation claim. If you think you do need to make a personal injury holiday claim make sure that you collect together any evidence such as medical reports and receipts of expenses you have had to meet. Also make sure that your accident, injury, or illness has been correctly reported to the authorities or parties it needs to be recorded with such as police, your hotel, travel company, and insurance provider.

What evidence do I need to support my claim for an accident on holiday in Formentera?

If you are looking to support your claim with a strong body of evidence, you may want to collect the following.

Evidence that the accident occurred- to prove that an accident occurred, you may need a police report, or photographs of the scene or your injuries. It could also be useful to draw a diagram of the positioning of vehicles if you’re injured in a car accident. It would also be a good idea to write down details of what has happened as soon as possible after the accident. This could help you to refresh your memory as time progress is. In addition to this you could collect witness details. That way, your lawyer could approach those people who have witnessed your accident and ask them for a statement.

Evidence of your injuries- in order to prove that you have suffered injuries in an accident, you would need to provide more than just a GP or hospital report. You would also need to attend an appointment with an independent medical specialist. They could take a look at your injuries and ask you some questions about what has happened and how your injury has affected you. Based on the information they collect, they could provide a medical report to evidence your injuries.

Evidence of costs- if you have incurred costs or loss of earnings, for example, you would need to provide documentary evidence of this.
