Italy is a very popular destination for UK holidaymakers and tourists. Over 3 million UK citizens visit Italy every year. Predominantly for summer sun holidays and city breaks, but also for fringe Italian tourism markets such as skiing, wine tasting and gastro tours. For most of the people who are visiting Italy, it is a safe place, and they have a great stay, before returning home to the UK. But for a percentage of people, their visit is marred by being injured in an accident, or coming down with an illness. Some people will have been harmed by the actions of a third party, and it is for these people that we have published this guide. What Should I Do If I Am Injured Or Become Sick?

Italy holiday accident statistics

Take a look at the graph above; it shows that tourist spending in Italy is steadily going up. This means more tourists, but also potentially more accidents. Part of the answer to the question, how much can I claim for injury or illness in Italy? is that it will depend on how well you are prepared for making a claim. If it is easy to prove who is liable, and your injuries are well documented, you could have a better chance of winning the maximum compensation possible. By taking steps such as these below, you will be well prepared for making a claim:

  • If there were any witnesses to the incident that caused you harm, ask them to provide you with their contact details. This is so they can be called upon to give testimony later on.
  • Visit the hospital to have your injuries or illness UK citizens get free emergency treatment in Italy (more on this below). This will ensure that your medical condition is recorded officially.
  • If you booked your holiday through a package holiday company, you must report the injury to them. Either call them in the UK, or find out if they have a local representative and report the incident to them.
  • If you intend to use your health or travel insurance to pay for private medical care, call them and let them know.
  • When you return to the UK, visit the hospital again to have your condition checked over. This will ensure that there is an official record in the UK health service.

Taking steps such as these above will help to streamline the claims process. If you are ready to start your claim, speak to one of the Accident Claims UK team on the number at the end of this page. You make also find these two related guides useful:

How To Get Assistance From the Emergency Services

No Italy holiday compensation guide would be complete without giving details of the emergency services and how to contact them. If you have been injured in an accident, all you need to do is call 112. You can use any telephone to do this, even if your mobile phone has a UK SIM card. When you dial 112, an English-speaking operator will go over the emergency with you, then send any emergency services they think are needed. You can also get hold of the emergency service directly, on these numbers:

  • 113 – for the police.
  • 115 – for the fire service.
  • 118 – for emergency medical treatment.

You could also try to get help from the UK Government, using the contact information at the end of this guide. You will find more detailed information about contacting the Italian emergency services at this link:

Accessing Healthcare In Italy

Before returning home to make holiday accident and illness claims, you will need to get the medical treatment you need while you are still overseas. Emergency treatment can be had by calling 112, as detailed in the section above. When you are taken to the hospital, as long as you have a valid European Health Insurance Card (EHIC) on you, then you will receive free or reduced rate treatment as if you were Italian. Please note though, that your EHIC won’t cover all types of medical treatment.

For example, you can’t get dental care, treatment for an existing illness, or outpatient care for free using your EHIC. If you do need these kinds of treatment, you will need valid insurance cover to pay for it. If you don’t have insurance, you will have to pay out of your own pocket. Accident Claims UK could potentially claim the cost of medical care back, as part of your compensation settlement. Speak to one of our team on the number at the bottom of the page to find out how.

How Long Do You Have To Claim Compensation For An Accident On Holiday?

There is a personal injury claims time limit in place in Italy, and you will need to start your claim within it. The time limit depends on the circumstances of your claim, thus:

Edit
Circumstances of Claim Time Limits
You booked your trip through a UK based package holiday vendor. 3-years.
You booked your trip yourself, without the aid of a travel agent. 6 years (time limits can vary – see Time Limit Advice for more information)
A road traffic accident. 2 years (with potential for extension).

Package Holiday Injury Compensation Claims

If you are injured while on a holiday that was booked as a package, from a UK based travel firm, a personal injury solicitor could be able to claim against the travel company for you. As long as you were injured while in transit on transport that was included in the package, or at a hotel that was included in the package, or whilst undertaking an activity that was part of the package, you should be able to claim.

This is because UK package tour firms are heavily regulated, to ensure that they provide a very specific minimum level of quality and safety on their holidays. If you are injured while on a package holiday, you must report the accident to the travel vendor. You can use the contact details in the table below to do this. Then when you return to the UK, give Accident Claims UK a call so that we can get started on your claim right away

Accident In A Hotel Compensation Claim

A hotel can present a number of safety and health hazards for its residents. If you come to harm whilst staying in a hotel overseas, a personal injury lawyer should be able to help you to claim. Typical ways that people are harmed in a hotel include:

  • Accidents in the pool area due to badly maintained equipment or no lifeguard being on duty.
  • Accidents in the hotel gym due to faulty equipment or no supervision for guests.
  • Food-related illnesses caused by bad food in the hotel dining room or restaurant.
  • Slips, trips or falls in the hotel garden or customer parking area due to damaged paving slabs.
  • Injuries caused by faulty room fittings, such as being electrocuted by a faulty light switch.

As you can see, there are many ways that a person can be harmed in a hotel while on holiday. No matter how you came to harm, Accident Claims UK should be able to help you to claim. Speak to one of our team on the number at the end of this page to proceed.

Claims For Accidents In Restaurants And Food Poisoning While Abroad

Italy is renowned for its food, wine and hospitality. UK holidaymakers are generally quite safe eating Italian food. However, from time to time a tourist comes down with something due to the food they have eaten. When they do, if it can be proven that the restaurant was at fault, a reason to make a personal injury claim will exist. Food poisoning can be caused in many ways, including:

  • Storing food at the wrong temperature.
  • Undercooking food.
  • Leaving food out on a buffet table for too long.
  • Preparing food in an unhygienic kitchen.
  • Food being served by unhygienic staff.
  • Washing food in a water supply not fit for drinking.

As you can see, there are many reasons why food might go bad and cause food poisoning. No matter the reasons, Accident Claims UK can help you get the compensation you are eligible for. Call one of our team on the number at the end of this guide to learn how. You may also have been injured in an accident at a restaurant. If so, check this guide:

Trips, Falls, Or Slips Leading To Italy Personal Injury Claims

One of the most common reasons that people make a personal injury claim abroad, is for slip, trip and fall accidents. These can happen at any time on your holiday. Starting with disembarking from the plane, through to getting into a taxi at the airport to take you home at the end of your trip. Slips, trips and falls are caused by hazards such as:

  • Wet floors that should have been signposted as a hazard.
  • Dirty floors that have not been cleaned or signposted as a hazard.
  • Damaged floor coverings such as torn carpets or cracked tiles.
  • Broken paving slabs or curbstones in the parking area.
  • Wet and slippery floors close to the hotel pool area.

As we can see, there are many ways a slip, trip or fall can happen. Accident Claims UK can help you to claim no matter how your accident was caused. Speak to one of our team on the number at the end of the page to proceed with your claim.

Watersport And Skiing Accident Abroad Claims

Italy is a popular destination for people who enjoy water and winter sports. And although the providers of these kinds of activities are tightly regulated in Italy, accidents can and do still happen. A major consideration here, is whether certain types of sports are excluded from your holiday insurance. For example, if you were to have a water skiing accident, and water skiing is specifically excluded from your holiday insurance, you would need to pay the cost of medical treatment yourself is it isn’t covered by your EHIC. Victims will then need to make water skiing accident claims, to claim back the cost of medical care. You could also be injured whilst participating in other organised excursions, on coach trips, in airport transfer accidents, and at the airport. Accident Claims UK can help with this, speak to one of our team on the number at the end of this guide to find out how.

Claims For Road Or Car Accidents In Italy

If you are injured in a road traffic accident that was not your fault while on holiday, you could be able to claim for a car accident in Italy. In 2016, there were just over 175,000 road traffic accidents in Italy, of which 3,200 of them resulted in one or more deaths. This means that Italy is not the most dangerous country in Europe for holidaymakers, but it also isn’t the safest.

If you are involved in a road traffic accident whilst overseas, Accident Claims UK can help you to get the compensation that you are entitled to. Speak to one of our team on the number at the end of the page to proceed with your claim today.

Can I Use A Solicitor In The UK For Italy Personal Injury Claims

If you are injured while on holiday overseas, you do not need to use a local solicitor in the country you were visiting. In fact, in many cases this would be a very difficult proposition, as keeping in contact with the solicitor would be problematic at best.

A better alternative is to use a UK legal firm, such as us here at Accident Claims UK. We are just as capable of handling overseas claims as we are claims in the UK. Speak to one of our team on the number at the end of this guide to get your claim started right away.

FAQ on Italy Personal Injury Claims

Could I make Italy personal injury claims on behalf of a child?

If you are responsible for a child who is injured in Italy due to an accident that is not their fault, you may be wondering whether they could claim compensation. Unfortunately, in the eyes of the law, children are unable to have the capacity to claim for themselves. However, you could register to be their litigation friend and could make a claim on their behalf. You would handle all of the decisions relating to the claim, and one of our personal injury solicitors who are authorised and regulated by the Solicitors Regulation Authority could assist you. You would usually have up until your Childs 18th birthday to claim on their behalf. However, if you chose not to do so, your child could claim once they reach 18 years of age. Making a decision on whether to launch a claim or whether to wait until your child comes of age could be tricky. We could help give you all the information you may need to make an informed decision on their claim.

Could I make Italy personal injury claims for the loss of a loved one?

Unfortunately, some holiday accidents and business trip accidents could be fatal. If your loved one has lost their life in an accident that was not their fault in Italy, you may wonder whether you’d be able to claim compensation. We could assess your case to see whether you could claim for funeral expenses, a bereavement award, or even financial support for dependants. We understand that going over your loved one’s death may be traumatic. This is why we would handle your claim with a sensitivity and respect it deserves.
